In no event shall our total aggregate liability to you for all claims arising out of or relating to these Terms or your use of the Website exceed the greater of (a) the amount you have paid to us, if any, in the twelve (12) months preceding the claim, or (b) Thai Baht 1,000 (One Thousand Baht).
Some jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages, so the above limitations may not apply to you in full.

9. Force Majeure
FIDELIS LIGHTHOUSE LLC shall not be liable for any failure or delay in performance of its obligations under these Terms where such failure or delay results from any cause beyond our reasonable control, including but not limited to acts of God, natural disasters, floods, fires, earthquakes, epidemics or pandemics (including but not limited to COVID-19 or similar events), civil unrest, governmental actions or restrictions, power outages, internet service provider failures, cyberattacks, strikes, or any other event outside our reasonable control (“Force Majeure Event”).
In the event of a Force Majeure Event, we will use reasonable endeavours to notify you of the circumstances and resume affected services as soon as reasonably practicable.
10. Privacy and Personal Data
Your use of the Website is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Our Privacy Policy explains how we collect, use, store, and protect your personal data in accordance with the Personal Data Protection Act B.E. 2562 (2019) (PDPA) of Thailand. 11. Governing Law
These Terms and any dispute or claim arising out of or in connection with them (including non-contractual disputes or claims) shall be governed by and construed in accordance with the laws of the Kingdom of Thailand, without regard to its conflict of law provisions.
The courts of Thailand, specifically those with jurisdiction in Bangkok, shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms or their subject matter or formation, unless resolved through the alternative dispute resolution mechanism described in Section 12 below.
12. Dispute Resolution
In the event of any dispute, controversy, or claim arising out of or relating to these Terms, or the breach, termination, or invalidity thereof, the parties agree to attempt to resolve the matter through the following process:
- Informal Negotiation: Either party may notify the other in writing of the dispute. The parties shall then attempt to resolve the dispute through good-faith negotiation within thirty (30) calendar days of the notice.
- Mediation: If the dispute cannot be resolved through informal negotiation, the parties may agree to submit the dispute to mediation under the mediation rules of the Thai Arbitration Institute (TAI) or the Thailand Mediation Center before resorting to litigation or arbitration.
- Litigation: If mediation fails or is not agreed upon, either party may pursue legal action in the competent courts of Thailand as described in Section 11 above.
Nothing in this Section shall prevent either party from seeking urgent injunctive or other equitable relief from a court of competent jurisdiction where necessary to protect its rights pending resolution of any dispute.
13. Modification of Terms
We reserve the right, at our sole discretion, to modify, revise, or update these Terms at any time. When we make changes, we will update the “Last Updated” date at the top of this page. We may also, at our discretion, notify you of material changes via a prominent notice on the Website or by email (if you have provided us with one).
Your continued use of the Website after any such changes constitutes your acceptance of the new Terms. If you do not agree to the modified Terms, you must stop using the Website immediately. We encourage you to review these Terms periodically to stay informed of any updates.
14. Termination
FIDELIS LIGHTHOUSE LLC reserves the right to terminate or suspend your access to the Website immediately, without prior notice or liability, for any reason, including but not limited to if you breach these Terms, violate any applicable law, or engage in conduct that we determine, in our sole discretion, is harmful to the Website, other users, or third parties.

All provisions of these Terms which by their nature should survive termination shall survive, including but not limited to ownership provisions, warranty disclaimers, indemnity, limitation of liability, governing law, and dispute resolution.
You may also terminate your use of the Website at any time by simply discontinuing your access. If you have a registered account, you may request deletion of your account by contacting us using the contact details provided in Section 17.
15. Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable under applicable Thai law or by a court of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it enforceable, or if such modification is not possible, such provision shall be severed from these Terms.
The invalidity, illegality, or unenforceability of any provision shall not affect the remaining provisions of these Terms, which shall continue in full force and effect. The parties agree to negotiate in good faith to replace any invalid or unenforceable provision with a valid and enforceable provision that achieves, to the greatest extent possible, the economic, legal, and commercial objectives of the original provision.
16. Entire Agreement
These Terms, together with our Privacy Policy and any other legal notices or agreements published by us on the Website, constitute the entire agreement between you and FIDELIS LIGHTHOUSE LLC with respect to your use of the Website, and supersede all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral, with respect to the Website.
No waiver by FIDELIS LIGHTHOUSE LLC of any term or condition set out in these Terms shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition. Any failure by FIDELIS LIGHTHOUSE LLC to assert a right or provision under these Terms shall not constitute a waiver of such right or provision.
